Mountech Cables LLC dba US IT Hardware (“US IT Hardware,” “we,” “us,” or “our”) is a reseller and distributor of information technology hardware, equipment, peripherals, software, and related products. US IT Hardware is not the manufacturer of the products it sells.
This Warranty Policy describes the warranty coverage applicable to products purchased from US IT Hardware and should be read together with our Return Policy and Terms and Conditions.
Nothing in this Warranty Policy is intended to exclude, restrict, or limit any right, remedy, warranty, or protection that cannot legally be excluded or limited under applicable federal, state, or local law.
1. Delivery Date
For purposes of this Warranty Policy and the Return Policy, “Delivery Date” means the date on which the applicable product is delivered to the customer or the customer's designated delivery address, as reflected by the applicable carrier's delivery record.
Unless otherwise expressly stated, all applicable US IT Hardware warranty, refund, and replacement periods begin on the Delivery Date, rather than the invoice date or order date.
2. Standard 30-Day Warranty
Unless otherwise stated for a particular product, US IT Hardware provides a Standard 30-Day Warranty beginning on the Delivery Date.
During this 30-day warranty period, an eligible product that is defective, non-functional, or otherwise fails to conform to the applicable product description may qualify for replacement in accordance with this Warranty Policy and the US IT Hardware Return Policy.
The Standard 30-Day Warranty is subject to the exclusions, conditions, and procedures contained in this Warranty Policy and the Return & Replacement Policy.
Refunds are governed separately by the Return Policy and are available only within the applicable refund period stated in that policy.
Customers are encouraged to report any suspected defect or product issue promptly so that US IT Hardware has sufficient time to evaluate and address the issue during the applicable warranty and replacement period.
3. Manufacturer Warranties
Products sold by US IT Hardware may also be covered by a warranty, service program, technical support program, or other warranty protection provided by the applicable manufacturer.
Where a manufacturer provides a warranty applicable to a product purchased from US IT Hardware, US IT Hardware will pass through to the customer the benefits of that manufacturer's warranty to the extent permitted by applicable law.
The manufacturer is responsible for the terms, conditions, duration, coverage, exclusions, and administration of its warranty.
A manufacturer's warranty may provide coverage extending beyond US IT Hardware's Standard 30-Day Warranty.
Manufacturer warranties may require the customer to contact the manufacturer directly for warranty service, technical support, repair, replacement, or other available remedies.
US IT Hardware does not independently extend or guarantee a manufacturer's warranty unless expressly stated otherwise in writing.
4. Relationship Between the Standard 30-Day Warranty and Returns/Replacements
The US IT Hardware Standard 30-Day Warranty and the Return & Replacement Policy operate together during the applicable 30-day period.
The Return Policy establishes the procedures and eligibility requirements for obtaining a refund or replacement, while this Warranty Policy establishes the applicable warranty coverage and limitations.
Unless otherwise stated for a particular product:
- Refund requests: must be submitted within 14 days of the Delivery Date.
- Replacement requests: may be submitted during the full 30-day period following the Delivery Date.
- US IT Hardware Standard 30-Day Warranty: applies during the applicable 30-day warranty period beginning on the Delivery Date.
- Manufacturer warranty: may provide additional coverage after the US IT Hardware 30-day period expires, depending on the applicable manufacturer's warranty.
A product does not automatically lose manufacturer warranty coverage merely because the US IT Hardware 30-day return, replacement, or warranty period has expired.
5. Warranty Exclusions
The Standard 30-Day Warranty does not cover problems caused by:
- misuse, abuse, neglect, accident, or improper handling;
- improper installation or configuration;
- operation outside the manufacturer's specifications;
- physical damage caused after delivery;
- unauthorized repair, modification, alteration, or disassembly;
- use with incompatible hardware, software, systems, or configurations;
- damage caused by electrical issues, power surges, environmental conditions, or other external causes;
- software, firmware, drivers, or third-party applications, except where expressly covered in writing; or
- normal wear and tear, where applicable.
These exclusions apply only to the extent permitted by applicable law.
6. Product Performance and Compatibility
US IT Hardware does not warrant that a product will:
- Meet the customer's particular requirements or expectations;
- Be compatible with the customer's existing hardware, software, network, operating environment, or configuration;
- Operate continuously or without interruption;
- Operate without defects or errors;
- Achieve any particular performance level or business result; or
- Remain compatible with future hardware, software, operating systems, technologies, standards, or configurations.
The customer is responsible for determining whether a product is suitable for the customer's intended application and technical environment.
Product specifications, features, compatibility, availability, and performance may be subject to change by the manufacturer.
7. Disclaimer of Other Warranties
Except for the Standard 30-Day Warranty expressly stated above and any other warranty expressly provided by US IT Hardware in writing, and to the maximum extent permitted by applicable law:
US IT HARDWARE MAKES NO OTHER EXPRESS OR IMPLIED WARRANTIES REGARDING ANY PRODUCT SOLD BY US IT HARDWARE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, US IT HARDWARE DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.
Any implied warranty that may otherwise arise by statute, course of dealing, course of performance, trade usage, or otherwise is similarly disclaimed to the maximum extent permitted by applicable law.
Where applicable law does not permit the exclusion of a particular implied warranty, that warranty shall apply only to the extent and for the period required by applicable law.
8. Software, Firmware, Drivers, and Digital Materials
Products may include or require software, firmware, drivers, utilities, licenses, or other digital materials supplied by a manufacturer or third-party provider.
Such software and digital materials may be governed by separate license agreements and warranty terms issued by the applicable manufacturer or software provider.
To the maximum extent permitted by applicable law, US IT Hardware does not warrant that software, firmware, drivers, downloads, or related digital materials will be uninterrupted, error-free, secure, or compatible with every system or configuration.
9. Technical Support and Services
To the extent US IT Hardware provides technical assistance, configuration assistance, installation assistance, troubleshooting, or other support services, such assistance is provided subject to the applicable terms of service.
US IT Hardware does not warrant that technical support or services will be uninterrupted, timely, secure, error-free, or capable of resolving every technical issue.
Any advice or information provided by US IT Hardware does not create an additional warranty unless expressly provided in writing by an authorized representative.
10. Customer-Accessed Materials and Downloads
Any software, firmware, drivers, files, documentation, updates, or other materials obtained through a US IT Hardware website, support service, or other online resource are accessed and used at the customer's discretion and risk, except to the extent otherwise required by applicable law.
Customers are responsible for maintaining appropriate backups and security measures.
To the maximum extent permitted by law, US IT Hardware is not responsible for loss or corruption of customer data arising from downloading, installing, modifying, or using such materials.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, US IT HARDWARE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO ANY PRODUCT OR SERVICE SOLD, PROVIDED, INSTALLED, CONFIGURED, SERVICED, OR SUPPORTED BY US IT HARDWARE.
This includes, without limitation, loss of profits, revenue, business, goodwill, data, or business opportunities.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, US IT HARDWARE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT OR SERVICE SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO US IT HARDWARE FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
Nothing in this section excludes or limits liability that cannot legally be excluded or limited.
12. High-Risk and Critical Applications
Unless expressly agreed otherwise in writing, products sold by US IT Hardware are not represented or warranted as suitable for applications where product failure could reasonably be expected to result in death, personal injury, or substantial property or environmental damage.
Such applications may include, without limitation:
- military or defense applications;
- medical or life-support equipment;
- aviation systems;
- nuclear facilities;
- traffic-control systems;
- emergency-response systems;
- disaster-prevention or disaster-response systems; and
- other safety-critical applications.
The customer is responsible for determining whether a product is appropriate for its intended application and for obtaining any required manufacturer certifications, approvals, testing, redundancy, or regulatory authorization.
13. Lifetime Warranty
Where a product or manufacturer warranty is described as a “lifetime warranty,” “lifetime” means the applicable product's commercial or supported life as determined under the applicable manufacturer's warranty terms, unless the manufacturer's written warranty expressly provides another definition.
A lifetime warranty does not necessarily mean the lifetime of the customer, customer's business, or customer's ownership of the product.
If a product has been discontinued or is no longer commercially supported, warranty coverage will be determined by the applicable manufacturer's warranty terms.
US IT Hardware does not independently guarantee lifetime availability of a product unless expressly stated in writing.
14. Manufacturer Warranty Claims
After the US IT Hardware Standard 30-Day Warranty period expires, customers may continue to have rights under an applicable manufacturer's warranty.
Customers may be required to submit warranty claims directly to the manufacturer.
The manufacturer determines, in accordance with its warranty terms, whether a product qualifies for warranty service and what remedy is available.
US IT Hardware may provide reasonable assistance in identifying the applicable manufacturer or warranty information where available.
15. No Modification of Warranty
No employee, representative, salesperson, or other person acting on behalf of US IT Hardware may modify, expand, or create a warranty on behalf of US IT Hardware unless expressly authorized in a written document signed by an authorized representative.
16. Statutory Rights
Nothing in this Warranty Policy is intended to exclude, restrict, or limit any warranty, right, remedy, or protection that cannot legally be excluded, restricted, or limited under applicable law.
If any provision is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in effect.
17. Changes to This Warranty Policy
US IT Hardware may update this Warranty Policy from time to time.
Unless otherwise required by applicable law or expressly agreed in writing, the Warranty Policy applicable to a purchase will generally be the version in effect at the time of that purchase.
